1. Who we are

trymamapaw.com (the "Site") and the MamaPaw brand are operated by Noire Eagle LLC, a Wyoming limited liability company (entity ID 2026-001915486), principal office 2106 House Ave, Suite 620, Cheyenne, WY 82001, United States ("MamaPaw", "we", "us", "our").

2. Acceptance

By accessing the Site, creating an account, or placing an order you agree to these Terms of Service (the "Terms"), together with our [Privacy Policy], [Refund & Guarantee Policy], [Shipping Policy] and [Disclaimer], each incorporated by reference. If you do not agree, do not use the Site.

3. Eligibility and territory

You must be at least 18 years old and legally able to enter into a contract. We sell and ship only to addresses within the United States [and its territories]. Orders placed from outside the United States may be cancelled.

4. Products are for dogs only

Our products are supplements for administration to dogs only. They are not for human consumption and not for use in other species. Keep out of reach of children. Follow the label directions and the weight-based dosing on the packaging. Read the full ingredient list before use and do not use the product if your dog has a known sensitivity to any ingredient.

5. No veterinary advice

Nothing on the Site, in our emails, or in our packaging is veterinary advice, diagnosis or treatment, and using the Site does not create a veterinarian-client-patient relationship. Always consult a licensed veterinarian before starting any supplement, particularly if your dog is pregnant or nursing, is a puppy or a senior, takes medication, is due for surgery, or has a diagnosed condition — and if your dog's condition does not improve or worsens. Never disregard or delay veterinary advice because of something you read here. In an emergency, contact a veterinarian or emergency animal hospital immediately.

6. Product claims and results

Our statements about our products have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease or condition.

We make no claim that any particular effect will occur, or that any effect will occur within any particular period of time, and we make no dose–response claim. Individual results vary with the dog, the underlying cause of any issue, diet, environment, grooming, other products in use, and consistency of administration. Nothing on the Site is a promise of any outcome for your dog. Testimonials and reviews reflect the individual experience of the person who wrote them and are not typical results.

7. Orders, pricing and availability

All orders are offers to purchase, subject to our acceptance. We may refuse, limit or cancel any order in whole or in part — including where we suspect fraud, reseller activity, abuse of our guarantee, quantity limits, pricing or description errors, or where required by law. If we cancel after payment, we refund in full.

Prices are in U.S. dollars and may change before you place an order. We are not obliged to honour an obvious pricing or typographical error, even after an order confirmation has been sent. Sales tax is calculated at checkout. Product images are illustrative; packaging may vary.

An order confirmation email is an acknowledgement, not acceptance. The contract is formed when we dispatch the goods.

8. Payment

By submitting payment details you represent that you are authorised to use the payment method and authorise us, through our payment processor, to charge the full order amount including tax and shipping. We do not store full card details; payments are processed by [Shopify Payments / Stripe / PayPal] under its own terms.

9. Bottle size, dosing and supply duration

Every bottle contains 60 mL. The dog-size option you select at checkout determines the daily dose, not the size of the bottle. How long a bottle lasts therefore depends on your dog's weight:

These are estimates based on daily use at the stated dose. Please check the figure for your dog before ordering.

10. Shipping, duties, title and risk

Delivery estimates are estimates, not guarantees. All applicable import duties and customs fees are paid by us; you will never receive a customs bill for a MamaPaw order. If a carrier ever invoices you for duties on our order, contact us and we will reimburse you in full. Title and risk of loss pass to you on delivery to the address you provide. 11. Returns, refunds and the 90-day guarantee

Our 90-day satisfaction guarantee requires no minimum period of use and no return of the product, and is limited to one refund per customer, household and shipping address on the first order. Full terms, including what is refunded and when we may decline a claim, are in the [Refund & Guarantee Policy], which forms part of these Terms.

12. Chargebacks

If something has gone wrong, contact us first — we can almost always resolve it faster than your bank. Initiating a chargeback in circumstances covered by our Refund & Guarantee Policy, or after a refund has been issued, is a breach of these Terms; we may dispute it with documentation and refuse future orders.

13. Email and SMS marketing (delete if not applicable)

By providing your email address or mobile number you consent to receive marketing communications from MamaPaw. For SMS: you agree to receive recurring automated marketing text messages at the number provided, including messages sent by an autodialer. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help. Carriers are not liable for delayed or undelivered messages.

14. Reviews and user content

If you submit a review, photo, video or comment, you must have actually used the product and the content must be your honest, first-hand experience. Do not submit content that is false, misleading, infringing or unlawful. If you received any product, discount, payment or other incentive in connection with your content, you must disclose it clearly and conspicuously.

You grant MamaPaw a worldwide, non-exclusive, royalty-free, perpetual, transferable, sub-licensable licence to use, reproduce, adapt, publish and display your content in any media for marketing and operating our business, together with the name or handle you submitted it under, without further compensation. You represent that you own or control the necessary rights and that any person appearing in your content has consented.

We may decline to publish, edit for length, or remove content, but we do not remove, suppress or reorder reviews because they are negative, and we do not create, buy or incentivise reviews that misrepresent genuine customer experience.

15. Intellectual property

The Site and its content — including the MamaPaw name and logo, text, graphics, product imagery, packaging design and layout — are owned by or licensed to Noire Eagle LLC. We grant you a limited, revocable, non-transferable licence to access the Site for personal, non-commercial purposes. You may not copy, scrape, frame, resell or create derivative works from the Site or our content, or use our marks, without prior written consent.

16. Acceptable use

You agree not to: use the Site unlawfully or fraudulently; interfere with or attempt to gain unauthorised access to the Site or its systems; use bots, scrapers or automated collection tools; or misrepresent yourself or your affiliation. We may suspend or terminate access for any violation.

17. Authorised sales channels

We sell exclusively through trymamapaw.com. We do not sell, and have not authorised anyone to sell, our products on Amazon, eBay, Walmart or any other marketplace. Any listing claiming to offer MamaPaw products elsewhere is not authorised by us, is not covered by our guarantee, and we cannot verify the authenticity, storage or handling of products bought there. You may not resell our products without our written authorisation.

18. Third-party links and services

The Site may link to or integrate third-party services. We do not control and are not responsible for third-party content, products or practices.

19. Disclaimer of warranties and limitation of liability

To the fullest extent permitted by law, the Site and our products are provided "as is" and "as available", and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure or error-free.

To the fullest extent permitted by law, MamaPaw and its members, officers, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or relating to the Site or our products, whether in contract, tort, strict liability or otherwise, even if advised of the possibility. Our total aggregate liability for any claim relating to a product or order will not exceed the amount you actually paid for that product or order.

Some jurisdictions do not allow these exclusions; there our liability is limited to the greatest extent permitted by law. Nothing excludes liability for fraud, personal injury caused by our negligence, or any liability that cannot lawfully be excluded.

20. Indemnification

You agree to indemnify and hold harmless Noire Eagle LLC and its members, officers, employees and agents from any claim, demand, loss, liability or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of a product, your failure to follow label directions or veterinary advice, or your content.

21. Dispute resolution — informal resolution, arbitration, class action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

21.1 Informal resolution first. Before starting arbitration or any proceeding, you agree to contact us at [support@trymamapaw.com] with a written description of the dispute and the relief sought, and to give us 60 days to resolve it informally. This is a condition precedent to arbitration.

21.2 Binding arbitration. Any dispute arising out of or relating to these Terms, the Site, or any product purchased from us that is not resolved informally will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. The arbitration may be conducted by document submission, telephone, videoconference, or in person in [Laramie County, Wyoming] or, at your election, the county where you reside. The award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs this section.

21.3 Class action and jury trial waiver. You and MamaPaw agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding, and that the arbitrator may not consolidate more than one person's claims. If this waiver is unenforceable as to a particular claim or a request for public injunctive relief, that claim or request is severed and heard in court, and the remainder arbitrated. You and MamaPaw waive any right to a jury trial.

21.4 Small claims. Either party may bring an individual claim in small claims court in lieu of arbitration.

21.5 Your right to opt out. You may opt out by emailing [support@trymamapaw.com] with the subject "Arbitration Opt-Out", stating your name, order number and address, within 30 days of your first purchase. Opting out does not affect any other part of these Terms.

21.6 Coordinated filings. If 25 or more similar demands are filed against us by or with the assistance of the same counsel or coordinated entity, they will be administered in staged batches of no more than [50], with a single arbitrator per batch and the parties cooperating in good faith on batching. Limitations periods are tolled for unfiled demands during batching.

21.7 Time limit. Any claim must be brought within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.

22. Governing law and venue

These Terms and any dispute arising from them are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods. Subject to Section 21, the state and federal courts in [Laramie County, Wyoming] have exclusive jurisdiction. Nothing here deprives a consumer of mandatory consumer-protection law of their state of residence that cannot be varied by agreement.

23. Changes to these Terms

We may update these Terms by posting a revised version with a new "Last updated" date. Changes apply prospectively; the version in effect on the date of your order governs that order. Material changes to Section 21 will not apply retroactively to disputes of which we had notice.

24. General

These Terms and the policies incorporated by reference are the entire agreement between you and us on this subject. Unenforceable provisions are severed; the remainder stays in force. Failure to enforce is not waiver. You may not assign these Terms; we may assign to an affiliate or in connection with a merger or sale of assets. We are not liable for failure or delay beyond our reasonable control. Notices to you may be sent to the email address on your order.
